I just read this thread and the talk about copyrighting particular patterns.
There's been so many stitchers who have preceded us, you think all they did was stitch soccerballs? Although people have not replicated my MTG or Maki bags, they are in no way restricted for copy. Anyone who wants to make a bag like that, go right ahead. In fact, there's actually two different variations on Maki. One with the orange as a pent and one with the orange as a hex.
There's so many possibilities with 32 panels and you can get so creative with a footbag's pattern and colours. Just because you've never seen a bag like that, doesn't mean it hasn't been done before. Footbag is a small, friendly community. Creating things like copyrighting patterns is about as annoying as us not being able to sell 32's on ebay because it's "copyrighted" by some company we don't even know.
I understand people want something that makes their bags special and different from others', but really, I can tell from mere sight or feel a Toby, Lonn, Ilja, Mirken, Mosher, Johnny, Abshire... etc. These people's bags stand out not because of a particular pattern, but they differenciate themselves with bags that have character in the way their fillers interact with the bag that is unique to them. I think that's more important than having a pattern to call your own. I want people to be able to recognize my bags at a tournament and go, "This is a Peng bag right?", no matter what the pattern.
